The victim of rape in broad daylight is simply known as Jane Doe, a Fairfield county woman who, 3 years ago, endured a brutal sexual assault in front of her two children.
The attack happened in the parking garage of the Stamford Marriott. The man who raped her, 56 year old Gary Fricker, was caught and sent away to prison for 20 years. But now, Jane Doe says she being victimized again.
She filed suit against the Marriott, alleging they didn't do enough to keep Fricker off the property. But it was Marriott's defense that has victims rights advocates fired up. They claim "the victim failed to exercise due care for her own safety and the safety of her children and proper use of her senses and facilities". Fricker also threatened to sexually assault the woman's children if she resisted.
When another car pulled near her van, she screamed. Three days later Fricker was found and arrested. The victims attorneys say that Fricker was wandering the property for several days before the attack and that hotel security was lax, failing to spot him or apprehend him.
The court papers detail a traumatized mother who did everything to protect her kids. Now, her attorneys say she feels like she been assaulted again & made to feel responsible for the rape she endured. Her attorneys also fear that Marriott's holding company, HD Realty Associates, may up the anti and publicly reveal the real name of Jane Doe, and her children.
The civil case is expected to go to trial next April.
