NEW HAVEN — A Connecticut police officer arrested for opening fire on an unarmed couple’s car and wounding a 22-year-old woman faced judge for the first time since the charges were filed.

Hamden officer Devin Eaton was arraigned Monday on felony assault and reckless endangerment charges in New Haven Superior Court. He has been free after posting $100,000 bail.

In the courtroom, Eaton was old to take hands out of his pockets by the judge before he agreed to a November 5 continuation date.

Eaton and his attorney were escorted out of the side door from New Haven Superior Court. Atty. Cerritelli said he had no comment because he does not yet have discovery. He says there are three pending matters: criminal, civil the Hamden Police internal investigation.

Authorities said Eaton and a Yale University officer opened fire on the car in New Haven on April 16 while investigating a reported attempted armed robbery in Hamden.

Officials said Eaton fired 13 times after the driver, Paul Witherspoon III, got out of the car unexpectedly.

Witherspoon was not injured. His girlfriend, Stephanie Washington, was seriously injured but survived.

The Yale officer was not charged.
