Stew Leonard's, manufacturer sued for mislabeled cookies that led to deadly allergic reaction

The lawsuit is seeking damages for wrongful death after a New York woman died from an allergic reaction earlier this year.

DANBURY, Conn. — The family of a New York woman who died from an allergic reaction to mislabeled cookies sold at Stew Leonard's is now suing the grocery store and the company that manufactured the cookies.

Órla Baxendale, 25, of New York died from a severe allergic reaction in January after eating Florentine cookies that had undeclared peanuts.

A recall was issued shortly after Baxendale's death. About 500 packages of the mislabeled cookies were sold at Stew Leonard's stores, according to the lawsuit.

The lawsuit seeks at least $15,000 in damages from the executives and involved department managers at Stew Leonard's and from Cookies United LLC for wrongful death.

The legal team representing Baxendale's family said in the lawsuit that the manufacturing and selling of the mislabeled cookies was "grossly negligent, intentional, reckless, callous, indifferent to human life, and a wanton violation."

When the Connecticut Dept. of Consumer Protection issued the warning about the cookies in late January, the two companies appeared to place the blame on each other, as Stew Leonard said Cookies United never told them the ingredients changed, but Cookies United said they told Stew's in July 2023 that the cookies now contain peanuts.

The lawsuit also cites the recalls that came shortly afterward, such as various chicken products and apple pie, all for undeclared ingredients.
